A man awaiting sentencing in two felony criminal cases is now facing more charges from an incident that occurred this week.
Zachary R. Garvey, 18, of 744 E. Court St., Apt. 190, Urbana, was charged with fifth degree felony breaking and entering along with misdemeanor charges of theft, criminal trespassing, criminal mischief, criminal damaging and resisting arrest following an on-foot chase with law enforcement Monday.
At 11:57 p.m. Monday, officers from the Urbana Police Division were asked to assist the Champaign County Sheriff’s Office in attempting to locate Garvey from an alleged breaking and entering case that had recently occurred in the 1600 block of West state Route 29, just outside city limits.
According to information from Urbana Police Chief Matt Lingrell, Garvey had last been observed running through a farm field eastbound toward the city.
Officers Brandon McCain and Robbie Evans arrived in the area of Railroad Street and began a foot search. Shortly thereafter, officers observed a male subject walking in the area of the 900-block of Railroad Street and kept watch on him until he disappeared behind a building at 938 Railroad St., when they then began hearing loud banging noises.
As the officers crept closer to the site, Garvey came walking from behind the building and into their view, where they watched him get inside a vehicle parked at the property.
At 12:23 a.m., the officers identified themselves as police and ordered Garvey to stop. Garvey proceeded to run from officers and a short foot pursuit ensued.
McCain caught up to Garvey as he was climbing over a fence near the dead end of Fulton Avenue and tried to take him into custody. Garvey wrestled with the officer, grabbing him by his duty belt and they continued to struggle until McCain, with assistance by Evans, was able to control and handcuff Garvey.
At the time of custody, Garvey was dressed in dark clothing with a hoodie and gloves and was carrying a backpack with what turned out to be stolen cell phones and car keys inside as well as a hatchet.
In checking the area, Lingrell stated, officers located a fresh set of boot prints that matched the boots Garvey was wearing. Those prints led up to a door to a garage that had been kicked in leaving fresh muddy prints on the door.
Though Garvey told police the cell phones and keys were his, officers were able to locate the owner of the car they observed him getting into and confirmed the property belonged to the car owner.
Garvey told police he had been injured earlier at a location in the 1600 block of West state Route 29 and asked for medical attention. He was transported by police to Mercy Memorial Hospital where he was checked and released.
After being interviewed and booked at the police division, Garvey was taken to the Tri-County Regional Jail.
According to the Champaign County Municipal Court’s website, Garvey’s bond was established at $30,000 on Tuesday and a pretrial hearing is scheduled for Jan. 9.
Lingrell noted the Champaign County Sheriff’s Office is handling the incident that was first reported in the county on West state Route 29.
Last month, Garvey pleaded guilty in the Champaign County Common Pleas Court to three counts of vandalism and one count each of petty theft and receiving stolen property in relation to vandalism in the city from last June. He also pleaded guilty to one count of unauthorized use of a vehicle from a separate case.
A sentencing hearing on the charges in those cases is scheduled for Jan. 18.
