The Indian Lake Local School District Board of Education took the following action during the Nov. 19 regular meeting.

Approved the Financial Report ending Oct. 31 and board bills as presented.

Approved the minutes from the Oct. 15 regular meeting.

Approved modifications to the estimated resources and appropriations, accepted the donation of a piano to Indian Lake Elementary with a value of $500 from family of Carl Burns and Mary Lou Wren, approved the establishment of a student needs fund (018) and its purpose and budget statement as submitted by the superintendent, and established Indian Lake Wrestling Invitational ticket prices: High School Adult, $8, Student $4. Admission prices are honored for the entire day including preliminaries and finals.

Approved the substitute employee list dated Nov. 8 as recommended by the Mid-West Regional Educational Service Center, approved substitute middle school lunchroom monitors, approved substitute bus aides and approved supplemental contracts.

Approved the contract with St. Marys City Schools for a Hearing Interpreter at the Jackson Center Hearing Impaired Unit for the 2018-19 school year at a rate of $22.00 per hour plus benefits at 7 hours per day based on the Jackson Center school calendar.

Approved the contract with Healthcare Billing Services to seek Medicaid reimbursement for services provided to students with disabilities.

Authorized and Consented to the Assignment of Remediation Contract with Buckeye Construction and Restoration, Ltd. for repair on the elementary roof and wall panels.

AUTHORIZING AND CONSENTING TO ASSIGNMENT OF REMEDIATION CONTRACT

The Superintendent recommends that the Board of Education for the Indian Lake Local School District (the “Board”) authorize and consent to the assignment of the remediation contract of the Indian Lake Elementary School, 8770 Co. Rd 91, Lewistown, OH 43333 (the “Elementary School”), from original contractor Buckeye Construction and Restoration, LLC (“Contractor”) to Buckeye Construction and Restoration, LTD. (“Assignee”).

Rationale:

A. That Owner and Contractor entered into a contract on October 31, 2018, for the AAC Panel Repair Project at Indian Lake Elementary School, 8770 County Road 91, Lewistown, Ohio (the “Contract”).

B. Contractor desires to assign its entire interest in the Contract to Assignee so that it is completely divested of any duties, obligations, rights, and remedies under the Contract (the “Assignment”).

C. Section 13.2.1 of AIA A-201-2017 General Conditions of the Contract requires the consent of Owner to the Assignment by Contractor of the duties, obligations, rights, and remedies under the Contract.

D. The proposed Assignee has indicated the remediation project will be staffed by the same critical employees of contractor and Assignee will provide a strengthened financial position and ability for increased bonding capacity.

E. The Superintendent, in consultation with legal counsel, does not believe permitting the assignment will have a detrimental effect on the elementary school remediation project.

NOW, THEREFORE, BE IT RESOLVED by the Board of Education for the Indian Lake Local School District as follows:

1. The Board authorizes the Superintendent to execute the relevant documents authorizing and consenting to the Assignment of the Contract from Contractor to Assignee for the elementary school remediation project.

2. The Board authorizes the Treasurer to void the purchase order issued in the name of Buckeye Construction and Restoration, LLC for the elementary school remediation project.

3. The Board authorizes the Treasurer to issue a new purchase order for the elementary school remediation project in the amount of $247,261, and to execute any necessary documents.

Approve the revised Board Policy 7450 – Property Inventory.

The next regular meeting for the Board of Education will be December 17, 2018 at 6:30 pm in the Board of Education Office located at 6210 State Route 235 N, Lewistown
