An Urbana man will serve time in prison for his conduct in two felony criminal cases while charges are pending in another case.
Zachary R. Garvey, 18, received a 46-month prison sentence during a sentencing hearing Wednesday.
Last year, Garvey was one of three people indicted for vandalism that occurred in Urbana last summer. The journal entry on Garvey’s sentencing hearing states he worked with two other adults and two juveniles to create $76,546.59 in total damage to three separate businesses.
Garvey pleaded guilty to three counts of vandalism and one count each of petty theft and receiving stolen property during a plea hearing in December.
He also pleaded guilty to one count of unauthorized use of a vehicle in another criminal case during the same hearing. A sentencing memorandum states this charge stemmed from a July 28, 2016, incident where he possessed and used a vehicle parked on the street outside of a resident’s home.
The vehicle was unlocked with the keys in it and Garvey proceeded to drive the vehicle to Kentucky.
Garvey was indicted again earlier this month on three counts of breaking and entering and one count each of criminal trespass, attempted grand theft of a motor vehicle, vandalism, criminal damaging or endangering, petty theft, obstructing official business and criminal damaging or endangering in relation to conduct from Jan. 3.
Garvey was on a personal recognizance bond with the special condition of house arrest when he committed the crimes alleged in this case.
The sentencing memorandum states during his plea hearing on Dec. 19, 2016, Garvey led the court to believe he was paralyzed from the knees down and unable to walk. During the Jan. 3 incident, Garvey was arrested following an on-foot chase with law enforcement where an Urbana Police officer caught him as he reportedly was climbing over a fence.
Garvey pleaded not guilty to the new charges on Jan. 9.
In addition to the prison sentence, Garvey is ordered to pay $19,136.65 in restitution to the local businesses affected in the vandalism case and $280 to the resident whose vehicle he stole.
