Man receives additional prison time for felony

A man already serving a prison term for drug possession was ordered to spend more time in prison after pleading guilty to a newer charge Monday.

Michael A. Fisher, 28, pleaded guilty to a third degree felony tampering with evidence charge during a final pretrial conference and then was sentenced to two additional years in prison. The new sentence is be consecutive to a sentence Fisher is currently serving for charges in Champaign County. As part of the plea resolution, another third degree felony charge of escape was dismissed during the hearing.

The tampering with evidence charge stemmed from conduct while Fisher’s previous criminal case was pending.

In that case, Fisher was originally charged with possession of heroin, aggravated possession of drugs, possession of drugs, possession of marijuana, possessing drug abuse instruments and illegal use or possession of drug paraphernalia stemming from a Feb. 20 incident in which the Urbana Police Division recovered drug items from a vehicle he was riding in.

Fisher was sentenced to 16 months in prison on May 18 after pleading guilty to one count each of possession of heroin and aggravated possession of drugs.

Prior to sentencing, the court revoked Fisher’s bond during a March 22 case scheduling conference but granted him the ability to be released on electronic monitoring on March 24 for the purpose of being present at a relative’s surgery.

A journal entry ordering a capias warrant states on March 25 the court was advised that Fisher violated the conditions of his release from the Tri-County Regional Jail by traveling to multiple unauthorized locations upon his release from jail, removing the electronic monitor bracelet from his ankle and failing to return to the jail.

The grand jury indictment contends Fisher hid the monitoring device in a bathroom and then failed to return to the jail as ordered.

During Monday’s sentencing, Fisher’s conduct after he discarded the ankle monitor was discussed. Fisher admitted that he used heroin after attending the surgery and was involved in an alleged criminal incident at the Logan County Wal-Mart.

Fisher is charged with identity fraud, illegal conveyance of drugs onto grounds of detention facility, aggravated possession of drugs and theft in Logan County in relation to this incident. He said this case is still pending.

Upon his release, Fisher is subject to post release control for a period of up to three years.
