Man receives additional prison time for jail assault

A man already serving a prison term received more time on his sentence last week after pleading guilty to charges involving an inmate assault at the Tri-County Regional Jail.

Devonte R. Pigue, 24, pleaded guilty to a fourth degree felony aggravated assault charge and fifth degree felony receiving stolen property charge Thursday and received a 22-month prison sentence.

The aggravated assault charge was introduced through a bill of information and a previous charge of felonious assault was dismissed as part of a plea resolution.

The charge against Pigue stems from a July 26 assault of inmate Derek Michael-Tyler Lore.

On Aug. 5, community control for Pigue from a 2014 Champaign County criminal case was revoked during a community merits and disposition hearing. He was sent to prison for 24 months which will be served consecutively to the new prison sentence.

Pigue was also fined $500 for the recent case.

Upon his release, Pigue is subject to post-release control up to three years.

Two other people were indicted for the assault, Jalen Baxter and Kevin D. Byrd.

Baxter, 22, pleaded guilty to aggravated assault on Sept. 29 and a sentencing hearing in his case is scheduled for Nov. 22. In Union County, Baxter was indicted earlier this year in Union County for possession of heroin and trafficking in heroin and pleaded guilty to a trafficking in heroin charge on Sept. 14. He was sentenced to 36 months in prison in September.

Byrd, 24, pleaded guilty to an aggravated assault charge introduced through a bill of information on Sept. 19 and received a six month prison sentence on Oct. 18.

In Union County, Byrd was indicted for possession of heroin and possessing criminal tools earlier this year before pleading guilty to a trafficking in heroin charge in September. A sentencing hearing in this case is scheduled for Nov. 22.

Man placed on community control for vandalism

The second of three people indicted for vandalism during the summer will serve time in jail as part of a community control sentence.

On Thursday, Kyle T. Duhl, 18, was placed on community control for a period of five years during a sentencing hearing. As part of community control, Duhl was ordered to serve the first six months of his sentence in the Tri-County Jail.

Duhl, Adrian D. Recker and Zachary R. Garvey were all charged in relation to vandalism that occurred in Urbana on June 17 resulting in heavy damage and a high value loss of property to multiple victims.

As part of community control, Duhl was ordered to gain admission to and complete the SEPTA Community Based Correctional Facility residential program, will be subject to random drug screens, shall obtain and maintain employment upon his release from the residential facility and observe a curfew of 9 p.m. to 6 a.m.

Other conditions of community control include having to write separate apology letters to each of victims in the case and Duhl having no contact with specific individuals and locations as ordered by the court.

Restitution in the case was ordered in the amount of $76,546.59 due to the Champaign County Preservation Alliance, B&D Freight Inc., All Phase Electric Company and Taylor Maintenance with each co-defendant ordered to pay $19,136.65.

If community control is revoked, Duhl faces a 46 month prison sentence.

Recker, 18, was also placed on community control for a period of five years in October. As part of this sentence he was also required to serve six months in the Tri-County Jail.

Garvey, 18, was indicted on three counts of vandalism, two counts each of breaking and entering and unauthorized use of a vehicle and one count each of criminal trespass, petty theft, criminal damaging or endangering, receiving stolen property and failure to comply with underage alcohol laws.

He was indicted again in September on one count each of unauthorized use of vehicle and receiving stolen property. The grand jury indictment contends these charges stem from conduct that occurred between July 28 and Aug. 4.

A final pretrial conference for Garvey is scheduled for Nov. 21.
