DAYTON, Ohio (AP) — A man charged in a shootout that killed a 1-year-old boy has been found guilty of murder and other charges in southwest Ohio.
Montgomery County’s prosecutor says 26-year-old Shawn Smith Jr. also was found guilty Thursday of felonious assault and weapons charges in the Jan. 14, 2016, shooting that killed Elijah Johnson and injured two adults.
Prosecutors say Smith went looking for a man who robbed him and opened fire while the other man was holding the child.
Smith testified the other man shot first and he fired in self-defense. The Dayton Daily News reports Smith said he didn’t know the man was holding a child and “cried a million nights” when he learned the child died.
The Dayton man could be sentenced to up to 79 years in prison.
