Suit alleges excessive force in cop shooting of suspect

CLEVELAND (AP) — A federal lawsuit alleges excessive force in a nonfatal shooting by a Cleveland police detective later charged with having drugs, and case records raise questions about whether the wounded drug suspect pulled a gun as police originally stated.

Police said suspect Joevon Dawson pulled out a gun before then-detective Jon Periandri fired at him.

Records show the only weapon recovered at the scene after the 2015 shooting was in the center console of the vehicle in which the suspect was riding. Dawson’s attorney says that indicates Dawson couldn’t have had the gun.

In response to the lawsuit, the city says Dawson exited the car, lunged at the officer, clamped down on his arm and caused the discharge.

A city spokesman says the internal investigation into the shooting is ongoing.
