COLUMBUS, Ohio (AP) — Ohio State University’s fired marching band director says after watching courts toss both his lawsuits seeking relief he now sees “for some injustices, there are just no legal remedies.”
A federal judge Friday dismissed Waters’ civil rights lawsuit that alleges reverse discrimination.
Waters was fired in July 2014 for ignoring a “sexualized culture” inside what fans call The Best Damn Band in the Land. He denied wrongdoing and filed the lawsuit seeking reinstatement and damages. A second defamation suit filed in state court was dismissed last month.
Waters said he’ll weigh his legal options, but Friday’s decision will likely end his two-year legal battle. His lawyers say Waters’ funds are exhausted.
Waters said the suits sought to restore his and the band’s reputations after a damaging report he calls flawed.
