Driver pleads not guilty to vehicular assault

A woman accused of striking a man with a vehicle pleaded not guilty Friday.

April D. McFarland, 39, was indicted this month on one count each of aggravated vehicular assault with a specification for forfeiture of property, vehicular assault with a specification for forfeiture of property, operating a vehicle under the influence of alcohol, a drug of abuse or a combination of them, and aggravated possession of drugs.

According to a court statement filed in the Champaign County Municipal Court, law enforcement was dispatched to the area of 941 S. Main St. in Urbana on April 25 in reference to a verbal rolling domestic report.

While en route, dispatch advised deputies to check a residence on South U.S. Route 68. Champaign County Sheriff deputies arrived and found George Hawkins on the pavement.

Deputies made contact with McFarland as her vehicle was leaving the scene.

McFarland told law enforcement she did not know what was going on and her friend was driving her vehicle and picked up Hawkins and got into a fight. Speaking further with McFarland, she advised she was driving and picked up Hawkins and had taken him to two places.

McFarland stated Hawkins fell out of the vehicle and started punching the pavement and her vehicle. She advised she asked a relative of Hawkins to get him and she was in an argument with Hawkins and left the scene.

McFarland stated she was drinking prior to picking up Hawkins and had smoked marijuana.

A witness advised seeing Hawkins standing on the pavement and he and McFarland yelling at each other. Hawkins reportedly fell on the ground and McFarland continued yelling at him.

The witness stated McFarland went forward in a vehicle and part of her front tire went on Hawkins’ rib cage.

Hawkins was transported to Miami Valley Hospital, Dayton, via CareFlight.

The grand jury indictment contends McFarland was driving under a suspension at the time of the offense. The indictment also contends the aggravated possession of drugs charge stems from March 28 to April 5.

Friday’s hearing was a continuation of an initial arraignment from Wednesday. During Wednesday’s hearing, McFarland’s bond from municipal court proceedings was continued and she was ordered to reside at a specific address, is prohibited from having any contact with Hawkins and from using a motor vehicle.

A case scheduling conference is scheduled for May 26.
