Havens arrested in connection with shooting
A Springfield man has been arrested and charged with violating a civil protection order in connection with a shooting that left his estranged wife critically injured in Urbana Township early Sunday morning.

Bond has been set at $75,000 and a previous 60-day suspended sentence has been re-imposed by Judge Susan Fornof-Lippencott due to the "prohibited contact between the parties" and the suspicious nature of the shooting.

Investigators released a 911 tape of a call made Sunday from 4960 E. County Line Road, Springfield, where Carolyn Havens, 42, was reportedly shot by her estranged husband, Timothy Havens, 38, of 859 Hillard St., Springfield.

Mr. Havens said the gun, a .38-caliber revolver, was laying by the bed where the couple were having sex around 7 a.m., according to the 911 recording. "We were having sex and it went off," he said.

Havens explained to the dispatcher that he attempted to throw the gun off the side of the bed when it discharged a round into Mrs. Havens' chest.

She was transported to Miami Valley Hospital in Dayton, where she remained listed in critical condition Monday afternoon.

Both Mr. and Mrs. Havens have permits to carry concealed handguns, and the firearm involved in the incident allegedly belonged to Mrs. Havens, said Sgt. Matt Melvin of the Champaign County Sheriff's Office.

Mrs. Havens filed for a protection order against Mr. Havens earlier this year, alleging domestic violence. On Sept. 8, he allegedly went to the County Line Road home and started arguing with Mrs. Havens and his stepson, then assaulted the stepson and a male friend of the stepson's.

In October, he pleaded guilty in municipal court to violating the protection order and one count of assault. The charge of domestic violence, which listed the stepson as the victim, was dismissed and Havens was given a suspended jail sentence of 60 days and ordered to complete anger management counseling and comply with the protection order, which remained in effect at the time of the shooting.

The shooting remains under investigation, according to the Champaign County Sheriff's Office. County Prosecutor Nick Selvaggio and Sheriff Brent Emmons "are hopeful to present the case in its entirety" at the next session of Champaign County Grand Jury, scheduled for Dec. 11.
